DirectConnectsm (Internet Banking), MobileConnectsm (Mobile Banking), and E-Statement Agreement

BY ACCEPTING THIS AGREEMENT, YOU ACKNOWLEDGE AND AGREE THAT THE TERMS AND CONDITIONS OUTLINED IN THIS AGREEMENT WILL APPLY TO AND GOVERN YOUR USE OF DirectConnectsm , MobileConnectsm and E-Statement (SERVICES) OFFERED BY Selfreliance Federal CREDIT UNION (Selfreliance FCU), AND THAT YOU HAVE READ AND UNDERSTAND THE TERMS OF THIS AGREEMENT, THEREBY CREATING A VALID AND BINDING LEGAL CONTRACT BETWEEN YOU AND Selfreliance FCU. IF YOU HAVE QUESTIONS ABOUT THIS AGREEMENT, CONTACT OUR INFORMATION SYSTEMS DEPARTMENT TOLL-FREE AT 888-222-8571, BEFORE ENTERING INTO THIS AGREEMENT.

The terms "Selfreliance FCU," "we" or "us" in this Agreement refer to Selfreliance Federal Credit Union. For purposes of these terms and conditions the term "Selfreliance FCU" includes Selfreliance FCU's affiliates, as applicable. The terms "you" and "your" mean a person who has an account at Selfreliance FCU and who applies to use Selfreliance FCU's DirectConnectsm MobileConnectsm, and E-Statement services (Services), requests to use such services and enters into this Agreement.

The terms "Business Day" in this Agreement means Monday thru Friday, excluding Federal Reserve holidays.

E-Statement is the Internet-based service in which Selfreliance FCU notifies you at your e-mail address to retrieve your periodic E-Statements, which you specify under the terms set forth in this Agreement.

What This Agreement Covers. This Agreement between you and Selfreliance FCU governs your use of any of Selfreliance FCU's DirectConnectsm, MobileConnectsm, and E-Statement services. You should read this Agreement carefully to understand your rights and liabilities if you register for and use the Services. Access to DirectConnectsm or MobileConnectsm will be provided through the Worldwide Web of the Internet at www.selfreliance.com or mobile apps. You are responsible for providing your own access to the Internet through the Internet or Mobile Service Provider of your choice. The terms and conditions of this Agreement are in addition to, and shall supplement, the terms, conditions, rules, and regulations that apply to the existing Membership Agreement and accounts or services with Selfreliance FCU which you currently use.

MobileConnectsm.These services permit Selfreliance FCU’s members (consumers, sole proprietors and other business members) to perform a number of banking functions on accounts linked to the service through the use of a mobile device or mobile smart telephone. Unless indicated otherwise by the context, "linked Selfreliance FCU accounts" or "linked accounts" refers to all of your accounts with Selfreliance FCU that you have linked to MobileConnectsm solution.

E-Statement Service. This Agreement describes your rights and obligations as a user of the E-Statement Service. It also describes the rights and obligations of Selfreliance FCU. Please read this Agreement carefully. By completing the E-Statement Enrollment form you elect and authorize us, at our discretion, to electronically notify you that your monthly statement is ready to be retrieved and reviewed.

Federal and State statutes may be enacted or amended in the future to provide for electronic delivery of account statements. Your acceptance also authorizes us, at our discretion, to provide electronic delivery of such statements pursuant to these statutes after they become effective. If there is more than one owner or authorized user on an account, notice to any one account owner or authorized user will be effective for all.

DISCLAIMER OF WARRANTIES:

ALTHOUGH Selfreliance FCU ATTEMPTS TO PROVIDE ACCURATE INFORMATION, NAMES, IMAGES, PICTURES, LOGOS, ICONS, DOCUMENTS, AND MATERIALS (COLLECTIVELY, THE "CONTENTS") ON THE SERVICES, IT MAKES NO REPRESENTATION, ENDORSEMENT, OR WARRANTY THAT SUCH CONTENTS ARE ACCURATE OR SUITABLE FOR ANY PARTICULAR PURPOSE. THE SERVICES AND THEIR CONTENTS ARE PROVIDED ON AN "AS IS" BASIS. USE OF THE SERVICES AND THEIR CONTENTS IS AT THE USER'S SOLE RISK. THE SERVICES AND THEIR CONTENTS ARE PROVIDED WITHOUT ANY REPRESENTATIONS, ENDORSEMENTS, OR WARRANTIES OF ANY KIND WHATSOEVER, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES OF TITLE OR ACCURACY AND ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THIRD PARTY PROPRIETARY RIGHTS, OR OTHERWISE, WITH THE SOLE EXCEPTION OF WARRANTIES (IF ANY) WHICH CANNOT BE EXPRESSLY EXCLUDED UNDER APPLICABLE STATE OR FEDERAL LAW. Selfreliance FCU ALSO MAKES NO REPRESENTATIONS, ENDORSEMENTS, OR WARRANTIES, EITHER EXPRESS OR IMPLIED, WITH RESPECT TO ANY SERVICE OPERATED BY A THIRD PARTY.

WE MAKE NO WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, WITH RESPECT TO THE USE AND ADEQUACY OF THE SOFTWARE PROGRAM USED TO ACCESS YOUR ELECTRONIC STATEMENT OR THE E-STATEMENT SERVICE WE PROVIDE UNDER THIS AGREEMENT. WE DO NOT WARRANT THAT THE SOFTWARE PROGRAM OR THE E-STATEMENT SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS.

FINALLY WITHOUT LIMITATION AS TO THE FOREGOING, IN REGARD TO LIMITATION OF LIABILITY. IN NO EVENT WILL Selfreliance FCU OR ITS SUBSIDIARIES, AFFILIATES, CONTRACTORS, OR THEIR RESPECTIVE EMPLOYEES BE LIABLE FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, WHETHER UNDER A CONTRACT, TORT OR ANY OTHER THEORY OF LIABILITY, ARISING IN CONNECTION WITH ANY PARTY'S USE OF THE SERVICES OR IN CONNECTION WITH ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, LINE SYSTEM FAILURE, LOSS OF DATA, OR LOSS OF USE RELATED TO THE SERVICES OR ANY SERVICE OPERATED BY ANY THIRD PARTY OR ANY CONTENTS OF THE SERVICES OR ANY OTHER SERVICE, WHETHER OR NOT FORESEEABLE, EVEN IF Selfreliance FCU IS AWARE OF THE POSSIBILITY OF SUCH DAMAGES. BY CONSENTING TO USE THE SERVICES, YOU AGREE TO WAIVE ANY AND ALL RIGHT TO ANY OF THE AFORESAID.

Limit of Selfreliance FCU and Other Providers' Responsibility. Selfreliance FCU agrees to make reasonable efforts to ensure full performance of the Services. Except as specifically provided in this Agreement or where the law requires a different standard, you agree that Selfreliance FCU (including its officers, directors, employees, agents, subsidiaries or affiliates or its third party providers of services related to the Services): (i) will be responsible for acting only on those instructions sent through DirectConnectsm or MobileConnectsm, which are actually received and cannot assume responsibility for malfunctions in communications facilities not under its control that may affect the accuracy or timeliness of messages you send; (ii) is not responsible for any losses or delays in transmission of instructions arising out of the use of any Internet or Mobile Service Provider or caused by any browser software; (iii) provides information to you on a best-efforts basis for your convenience and does not guarantee such information; (iv) is not liable for any deficiencies in the accuracy, completeness, availability or timeliness of such information or for any investment or other decision made using this information; (v) is not responsible for any computer virus or related problems which may be attributable to DirectConnectsm or MobileConnectsm or to any services provided by any Internet or Mobile Services Provider. We shall have no liability for failure to perform any E-Statement Service, or for any disruption or delay in performing E-Statement Service, in the event of such failure, disruption or delay is due to circumstances beyond our reasonable control, including, but not limited to, Acts of God, Acts of War, failure or disruption of electrical power, computer equipment, telecommunication systems, your ISP, or weather conditions. You are responsible for obtaining, installing, maintaining, and operating all computer hardware and software necessary for receiving E-Statements. Selfreliance FCU will not be responsible for any errors or failures from the malfunction or failure of your hardware or software.

Use of SERVICES. Contents are included in the Services solely for the personal use of Services users. You may not copy (other than a copy for personal use), modify, distribute, transmit, display, perform, reproduce, transfer, resell, or republish any of the Contents of the Services without the prior written consent of Selfreliance FCU, which may be withheld in its sole discretion.

Copyrights and Other Intellectual Property. Except where otherwise expressly noted or as noted below, all Contents of these Services, including the graphics, icons and overall appearance of the Services, are the sole and exclusive property of Selfreliance FCU or affiliates. Certain Selfreliance FCU's trademarks and/or servicemarks are also listed below. The posting of the Contents of these Services neither constitutes a waiver of any of Selfreliance FCU's proprietary rights or any other party's proprietary rights, including but not limited to, copyrights, trademarks, service marks, patents, and other intellectual property, nor a transfer by implication, estoppel, or otherwise of any such rights or of any license to the Services user or to any third party. Contents of the Services are protected by United States and international copyright laws, both as individual works and as a collection and by United States and international trademark laws. You agree not to delete any copyright, trademark or similar notice from any Contents you obtain from the Services.

The display of third party trademarks within these Services does not grant a license of any kind to the reader. Any downloading of material contained in the site, or of any site linked to the site may be a violation of federal trademark and copyright laws. Any downloading of Contents of these Services or any Services linked to these Services may be a violation of federal and other trademark laws and federal copyright laws.

Links to Other SERVICES. Selfreliance FCU may establish links between these Services and one or more SERVICES operated by third parties. Selfreliance FCU has no control over any such other SERVICES or the contents therein. The existence of any such links shall not constitute an endorsement by Selfreliance FCU of such SERVICES, the contents of the SERVICES, or the operators of the SERVICES.

Changes in Terms. Selfreliance FCU may change Services, its terms, including fees, set forth in this Agreement at any time. You will be notified of any such change as required by applicable law, either by mail or by an electronic message. If a change notice is required, we will provide you with this notice at least thirty (30) days prior to implementing the change. However, if we deem a change necessary to maintain or restore the security of your account or any aspect of the Services system, we may make the change without any prior notice, with subsequent notice to you if such change is made permanent. You understand that, by using the Services, after a change becomes effective and after you are notified of the change, you are agreeing to the change.

Governing Law. The terms and conditions of this Agreement shall be governed by and construed in accordance with the laws of State of Illinois without regard to its conflicts of law provisions. Your existing account relationships shall continue to be governed by and construed in accordance with the laws of the state where the Selfreliance FCU branch at which you initially established your account is located. Any issue relating to an account or service with Selfreliance FCU which you access through DirectConnectsm or MobileConnectsm: shall be governed by the laws specified in the agreement for that account or service if there is a separate agreement for that account or service.

Venue. Disputes arising from the use of these Services shall be exclusively subject to the jurisdiction of Circuit Court of Cook County.

Severability. To the extent any portion of these Terms and Conditions is determined to be unenforceable by a court of competent jurisdiction, such portion will be modified by the court solely to the extent necessary to cause such portion to be enforceable, and these Terms and Conditions, as so modified, shall remain in full force and effect.

Waiver. No waiver by Selfreliance FCU of any right under or term or provision of these Terms and Conditions will be deemed a waiver of any other right, term, or provision of these Terms and Conditions at that time or a waiver of that or any other right, term, or provision of these Terms and Conditions at any other time.

Assignment. Selfreliance FCU may assign its rights and delegate its duties under this Agreement to a company affiliated with Selfreliance FCU or to any other party. You may not assign any of your rights or duties under this Agreement at any time.

Entire Agreement. This Agreement is the entire agreement between you and Selfreliance FCU regarding your use of the Services, and it supersedes any prior discussions and agreements between you and Selfreliance FCU regarding the Services, and supersedes any marketing or other similar material pertaining to the Services delivered to you in writing, verbally or obtained at any Selfreliance FCU site or the site of any Internet Service Provider.

Joint or Business Accounts. When your Services are linked to one or more joint or business accounts, we may act on the verbal, written or electronic instructions of any authorized signer.

Opt Out Election/Termination. Your Services remain in effect until they are terminated by you or Selfreliance FCU. You may cancel your Services at any time by notifying us of your intent to cancel in writing, through DirectConnectsm secure mail, or by calling us at 773-328-7575. This cancellation applies to your DirectConnectsm, MobileConnectsm, or E-Statements services, and does not terminate your Selfreliance FCU deposit or credit accounts. You must cancel any scheduled payments prior to notifying us that you are discontinuing the Service. If you choose to cancel your Online or Mobile Banking services, any pending payments will be canceled.

We may terminate your participation in Services for any reason, including inactivity, at any time. We will try to notify you in advance, but we are not obliged to do so. Selfreliance FCU will use commercially reasonable measures to notify you in advance of any such termination, but Selfreliance FCU is not obligated to do so.

Contact by Selfreliance FCU or Affiliated Parties. No Selfreliance FCU or Payee employee, nor any company affiliated with Selfreliance FCU will contact you via email or phone requesting your password. If you are contacted by anyone requesting this information, please contact us immediately.

Service Hours and Interruptions in Services. The Services are available 365 days a year and 24 hours a day, except during system maintenance and upgrades. Selfreliance FCU may on a regular basis perform maintenance on Selfreliance FCU equipment or systems which may result in interruption of Services. Selfreliance FCU will not incur any liability to you as a result of any such interruptions.

DirectConnectsm and MobileConnectsm Services for Consumers and Businesses. You may use DirectConnectsm and MobileConnectsm to:

  • Perform account balance inquires and transaction history detail on all linked Selfreliance FCU accounts.
  • View and print online images of member checks.
  • Transfer money between your accounts.
  • Place a stop payment order on any outstanding check(s).
  • Download Transaction History - currently, all versions of Quicken, QuickBooks, and Microsoft Money are supported, as well a generic text type file for use in other software.
  • View tax information for all your accounts.
  • Change the Password and User ID that are used to access the system. Password requirements are detailed below.
  • Enter or Change Your E-mail Address.
  • Enroll in DirectPaysm.
  • Access your Selfreliance FCU VISA® Account.
  • Send us secure mail messages and questions regarding your accounts.
  • Set up account alerts and notifications.
  • Mobile deposits – make mobile deposits by taking a photo of your check and depositing right from your mobile device.

Not all services are available on mobile devices.

Password Protection/Responsibility. You are assigned a Password when you apply and are approved for DirectConnectsm or MobileConnectsm. It is your responsibility to create your own Password; thereby assuring that no one else can gain access to your information. In addition to your Password, initially, you will be required to answer six (6) security questions, select an image, and create a phrase to insure your on-line banking security; to access your accounts via MobileConnectSM, initially, you will be required to register your mobile device by entering a security code delivered to the phone number we have on records for your membership. In the event you forget your Password or have trouble logging into your account, contact Selfreliance FCU's Information Systems Department at 888-222-8571 and you will be assigned a new temporary Password. Selfreliance FCU recognizes the importance of selecting Passwords, and securing those Passwords. Selfreliance FCU has implemented the following Password policy:

Your new Password must:

  • be between 8 and 15 characters long.
  • not contain more than two consecutive characters from your user ID or full name (i.e. if your name is "Jonathan", you cannot have "ath" in your password).
  • not use spaces, apostrophes (') or angle brackets (< >).
  • meet three of the four following requirements:
    • contain one uppercase letter (A - Z).
    • contain one lowercase letter (a - z).
    • contain 1 number (0 - 9).
    • contain one non-alphabetic character (i.e. !, @, #, $, %).
  • passwords are case sensitive: abcde1 is not the same as ABCDE1.

You will be locked out after 3 invalid login attempts.

Use of your Security Password. You agree not to allow anyone to gain access to the Services or to let anyone know your Password used with the Services. You further agree that Selfreliance FCU has no control as to the persons who have access to your personal computer or mobile device and your Password. Selfreliance FCU will not be liable for any unauthorized access to your personal computer or mobile device using your Password. You agree that it is your responsibility to initiate and maintain the highest level of password security procedures to prevent any unauthorized access to your personal computer, mobile device, or unauthorized use of your Password.

Notice of Unauthorized Access. If you believe that someone has obtained access to your account without your permission, immediately call the Internet Service Coordinator at Selfreliance FCU, 888-222-8571, during regular business hours.

For your protection, sign off after every session.

DirectConnectsm and MobileConnectsm Encryption. Data security between your computer or mobile device and Selfreliance FCU servers is handled through a security protocol called Secure Sockets Layer (SSL). SSL provides data encryption, server authentication and message integrity for an Internet connection. In addition, SSL provides a security "handshake" that is used to initiate the connection. This handshake results in the client and server agreeing on the level of security they use and fulfills any authentication requirements for the connection.

Selfreliance FCU will use commercially reasonable measures, consistent with industry standards, to maintain a reasonable level of security over the information contained in the electronically delivered account statement. The Selfreliance FCU system currently supports and requires SSL data encryption at the 128 bit level, the current standard in today's browser software.

You understand that these industry standards are dynamic and constantly developing. By accepting this Agreement, you acknowledge and understand that there are risks to electronic delivery of account statement, including, but not limited to, delay or failure of delivery due to technical difficulties, weather conditions, matters beyond our reasonable control, or interruption and/or alteration of such account statement by third parties in spite of Selfreliance FCU's commercially reasonable security measures.

By accepting this Agreement, you represent that you have considered our security measures, and find that our security measures are commercially reasonable. In reaching this conclusion, you have considered the historical and potential future content of your statement; the risks associated with electronic delivery of account statement, and our security procedures. If you conclude that our security procedures cease to be commercially reasonable in the future, you must terminate this Agreement immediately in accordance with the procedure outlined above.

Required Computer and Software Specifications. Your device and Internet or Mobile Service Provider (ISP) must meet all of the following specification for DirectConnectsm, MobileConnectsm, and E-Statement access:

  • Minimum Required Computer Specification:
    • 256 MB RAM
    • 200 MB Free Disk Space
    • Windows Vista. Windows 7, Mac OS X 10.5 or Above
    • Internet Explorer 9 or Above, Safari 6.1 or Later, Firefox 30 or Later, Chrome 35 or Later.
    • Latest Adobe Acrobat Reader is required for E-Statements functionality
  • Minimum Required Mobile Device Specifications:
    • iOS 6.0 or Later. Compatible with iPhone, iPad and iPad touch.
    • Android 2.2 or Later

Security. In order to maintain secure communications and reduce fraud, you agree to protect the security of your numbers, codes, marks, signs, public keys or other means of identification. Selfreliance FCU reserves the right to block access to Services to maintain or restore security to Selfreliance FCU systems if Selfreliance FCU reasonably believes your password have been or may be obtained or are being used or may be used by an unauthorized person(s). Subject to the requirements of state and federal law, and the terms and provisions of this Agreement, you are liable and responsible for all DirectConnectsm or MobileConnectsm transactions made using your means of identification, whether those transactions are made by you or any person you authorize, permit or enable to have your means of identification (even if the person exceeds your authority) or by any person who obtains through you, by whatever means, your means of identification. If you have given someone your means of identification and wish to terminate their authority, or if you know or believe that your means of identification otherwise is compromised, you must notify Selfreliance FCU so that Selfreliance FCU can take the necessary steps to change the means of identification (see generally, the "Unauthorized Transfers" section below). You agree to defend, hold harmless and indemnify Selfreliance FCU from and against any and all claims of any nature arising out of any such access by a person you have authorized, permitted or enabled to have access to your Selfreliance FCU accounts via DirectConnectsm or MobileConnectsm. You understand that electronic messages and communications sent via the Internet are not necessarily secure and that Selfreliance FCU does not recommend that you send information which you consider confidential concerning your accounts via the Internet. You agree to take reasonable precautions to safeguard your password and/or any other means of identification, to not leave your device unattended while using DirectConnectsm or MobileConnectsm and to always exit completely (log out) after using it.

Transfers and Payments. When you instruct Selfreliance FCU to transfer funds between your accounts through DirectConnectsm or MobileConnectsm, you authorize Selfreliance FCU to withdraw the necessary funds from the account you designate. As with any funds transfer request, whether or not utilizing DirectConnectsm or MobileConnectsm, you agree that you will instruct Selfreliance FCU to make a withdrawal only when a sufficient balance is or will be available in your designated account. Selfreliance FCU will not be obligated to act on any withdrawal instruction from you if sufficient funds, including overdrafts, are not available in the account(s) you designate.

Fund Transfers through DirectConnectsm or MobileConnectsm between some of your accounts may be limited. Federal regulations limit the number of pre-authorized, automatic or on-line banking transfers from what is commonly known as a share (savings) account or a market share account to no more than six transfers and withdrawals, or a combination of such transfers and withdrawals, per calendar month or statement cycle, to another of your accounts or to a third party by means of an online (web based), preauthorized, or automatic transfer. If you exceed the transfer limitations in any statement period, we may refuse or reverse a transfer and we may assess fees against, suspend, or close your account with Selfreliance FCU. Please refer to our Service Fee Schedule for the charges.

Canceling Transfers and Payments. You cannot cancel a one-time immediate transfer after it has been submitted and the information has been transmitted to us.

Placing a stop payment through DirectConnectsm. A stop payment request will be effective immediately upon your request. A stop payment fee will apply for every stop payment you request. Please refer to our Service Fee Schedule for the charges.

YOU MAY NOT STOP PAYMENT OF ELECTRONIC FUND TRANSFERS ON DirectConnectsm. Please contact the Bookkeeping Department for this request.

Fee Schedule. There are currently no monthly maintenance or transaction fees for DirectConnectsm, MobileConnectsm or E-Statement Services. However, you are responsible for charges by any Internet or Mobile Service Provider you use. Your use of these Services does not eliminate, waive or change any generally applicable fees and charges that Selfreliance FCU imposes on certain transactions or situations involving your accounts. Without limiting the generality of the foregoing, we note that our Service Fee Schedule (which can be found on our Web Site by clicking on the link to Disclosures) will apply to certain transactions while using DirectConnectsm or MobileConnectsm.

Communications. You agree that you may receive this Agreement, related disclosures and all other communications from Selfreliance FCU electronically and that Selfreliance FCU may respond to you with an electronic communication, even if your communication that we are responding to was not originally in electronic form. If Selfreliance FCU sends you an electronic communication, Selfreliance FCU will consider it received within three (3) calendar days of the date that it was sent, just like communications via U.S. Mail, regardless of whether or not you sign on to your specified e-mail account within that time frame.

To the extent permissible under state or federal law, electronic communications that you send to Selfreliance FCU will not be considered effective until we receive them and have a reasonable opportunity to act on such communications. It is therefore important that you consider reporting situations requiring immediate attention to us by calling Selfreliance FCU toll-free at 888-222-8571, in addition to providing electronic communication. Selfreliance FCU may require written confirmation of any communication as well. Note that certain communications required or permitted in this Agreement must be sent in writing by mail.

Electronic Mail. If you send Selfreliance FCU an electronic mail message at info@selfreliance.com, Selfreliance FCU will be deemed to have received it on the following business day. Selfreliance FCU will have a reasonable time to respond to your e-mail.

You should not rely on electronic mail if you need to communicate with Selfreliance FCU immediately (e.g., if you need to report an unauthorized transaction from one of your accounts, or if you need to stop a payment that is scheduled to occur).

Financial Institution's Liability. If we do not complete a transfer to or from your account on time or in the correct amount according to our Agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance:

  • If, through no fault of ours, you do not have enough money in your account to make the transfer.
  • If you have overdraft protection and the transfer would exceed the available funds.
  • If your computer, a mobile device, the software, phone lines, any browser, our computer system or any aspect of DirectConnectsm or MobileConnectsm were not working properly or were temporarily unavailable and you knew about the breakdown or problem when you started the transfers or transactions.
  • If circumstances beyond our control (such as fire, flood, Acts of God, Acts of War) prevent the transfer, despite reasonable precautions that we have taken.
  • If the funds are subject to legal process or other encumbrance restricting such transfer.
  • There may be other exceptions stated in our Agreement with you.

Unauthorized Transfers - Member Liability. Your Liability for Unauthorized Use. You are responsible for all transfers you authorize using DirectConnectsm or MobileConnectsm under this Agreement. If you permit other persons to use your Password, you are responsible for any transactions they authorize or conduct on any of your accounts.

Tell us AT ONCE if you think your Password or other DirectConnectsm or MobileConnectsm identification has been lost, stolen or used (or may be used) without your permission, or your DirectConnectsm or MobileConnectsm has otherwise been (or may be) used without your permission. Telephoning is the best way of minimizing your possible losses.

If you tell us within 2 business days after you discover your DirectConnectsm or MobileConnectsm Password or other means to access your account has been lost, stolen or used without your permission, your liability is no more than $50.00 should someone access your account without your permission. If you do not tell us within 2 business days after you learn of such loss or theft, and we can prove that we could have prevented the unauthorized use of your Password or other means to access your account if you had told us, you could be liable for as much as $500.00.

If you do not tell us within 60 days after the monthly statement was mailed or E-Statement availability notification was sent to you, you may not get back any money you lost after the 60 days if we can prove that we could have stopped someone from taking the money if you had told us in time. If a good reason (such as a long trip or hospital stay) kept you from telling us, we may extend the time period.

E-mail Address. We will send periodic notification to you via e-mail to the last known e-mail address provided by you. You agree to inform us promptly of any change of your e-mail address using the procedures set forth below in Changing Your E-Mail Address. If you have not notified us of any change to your e-mail address, you agree that your failure to provide us with a valid e-mail address is the lack of ordinary care on your part, and we will not be responsible for any loss that occurs as a result of this failure. If we become aware that you are not receiving your E-Statement, we will send your Statement to you via U.S. Mail within 15 business days to your last address known to us, however, we will have no liability for our failure to do so except as otherwise provided for in any applicable Federal statute.

Changing Your E-mail Address. The procedure for changing your current e-mail address is to simply go to DirectConnectsm at www.sefreliance.com and logon using your User ID and Password. From the Menu Options located in the top right corner, select Settings, which will direct you to Change E-mail Address. This change becomes effective immediately. You will receive a notification to your old e-mail address regarding the requested change shortly thereafter.

Other Agreements. In addition to this Agreement, you and Selfreliance FCU agree to be bound by and comply with the requirements of the agreements applicable to each of the accounts for which you elect to receive electronic statement. Your use of the E-Statement Service is your acknowledgement that you have received these agreements and intend to be bound by them. You should review other disclosures received by you when you open your accounts at Selfreliance FCU.

YOUR BILLING RIGHTS

This notice contains important information about your rights and responsibilities under the Fair Credit Billing Act.

NOTIFY US IN CASE OF ERRORS OR QUESTIONS ABOUT YOUR STATEMENT OF ACCOUNT.

PROMPT STATEMENT REVIEW

You must promptly review your electronic statement and any accompanying items. If you allow someone other than you to review your statements, you must still review the statement for any errors, mistakes, irregularities and/or any omissions, because you will be responsible for the wrongful acts of your employees and agents. Any applicable time periods within which you must notify us of any errors on your account statement shall begin on the day you are notified via e-mail by Selfreliance FCU that your monthly statement is available for you to retrieve on DirectConnectsm, regardless of when you receive and/or open the E-Statement.

We must hear from you no later than sixty (60) days after we sent you the first statement on which the error or problem appeared. You can telephone us, but doing so will not preserve your rights. In your letter, give us the following information:

  • Your name and account number,
  • The dollar amount of the suspected error,
  • Describe the error and explain, if you can, why you believe there is an error. If you need more information, describe the item you are not sure about.

Your rights and our responsibilities after we receive your written notice. We must acknowledge your letter within 30 days, unless we have corrected the error by then. Within 90 days, we must either correct the error or explain why we believe the statement was correct.

After we receive your letter, we cannot try to collect any amount you question, or report you as delinquent. We can continue to bill you for the amount you question, including finance charges, and we can apply any unpaid amount against your credit limit. You do not have to pay any questioned amount while we are investigating, but you are still obligated to pay the parts of your statement that are not in question.

If we find that we made a mistake on your statement, you will not have to pay any finance charges related to any questioned amount, nor the questioned amount. If we didn't make a mistake, you may have to pay finance charges, and you will have to make up any missed payments on the questioned amount. In either case, we will send you a statement of the amount you owe and the date that it is due.

If you fail to pay the amount that we think you owe, we may report you as delinquent. However, if our explanation does not satisfy you and you write to us within ten (10) days telling us that you still refuse to pay, we must tell anyone we report you to that you have a question about your statement. In addition, we must tell you the name of anyone we reported you to. We must tell anyone we report you to that the matter has been settled between us, when it finally is.

If we don't follow these rules, we can't collect the first $50 of the questioned amount, even if your statement was correct.

In case of errors or questions about your ELECTRONIC TRANSFERS. If you think an electronic transfer on your E-Statement wrong, or if you need more information about an electronic transfer on an E-Statement, write us at the address below no later than 60 days after we sent you the FIRST E-Statement on which the error or problem appeared:

In your letter, give us the following information:

We will investigate your complaint and will correct any error promptly. If we take more than 10 business days to do this, we will credit your account for the amount you think is in error so that you will have use of the money during the time it takes us to complete our investigation.

THE FINANCE CHARGE ON ALL CREDIT UNION CONSUMER LOANS IS COMPUTED BY APPLYING THE PERIODIC RATE TO THE UNPAID BALANCE FOR THE ACTUAL TIME SUCH BALANCE REMAINS OUTSTANDING. THE BALANCE USED TO COMPUTE THE FINANCE CHARGE IS THE UNPAID LOAN BALANCE EACH DAY AFTER PAYMENTS AND CREDITS ARE SUBTRACTED AND NEW ADVANCES OR OTHER CHARGES ARE ADDED. PLEASE REFER TO YOUR MORTGAGE DOCUMENTS FOR LOANS SECURED BY REAL ESTATE FINANCIAL CHARGE COMPUTATION.

IF YOU WISH TO ESTABLISH DirectConnectsm, MobileConnectsm, and E-Statements WITH Selfreliance FCU AND IF ALL OF THE FOREGOING IS ACCEPTABLE TO YOU, YOU MAY PROCEED TO COMPLETION OF THE REQUIRED APPLICATION. BY SUBMITTING A THE APPLICATION TO Selfreliance FCU, YOU WILL BE ACKNOWLEDGING AND AGREEING THAT THE TERMS AND CONDITIONS OUTLINED IN THIS AGREEMENT WILL APPLY TO AND GOVERN YOUR USE OF SERVICES.
